Educational leader: regulation 118, the role, and what support means under Element 7.2.2

Last reviewed: 29 October 2026. Checked against the Education and Care Services National Regulations, reprint current as at 12 August 2026.

Quick answer

Regulation 118 requires the approved provider to designate, in writing, a suitably qualified and experienced educator, co-ordinator or other individual as educational leader to lead the development and implementation of educational programs in the service. No particular qualification, hours or role description is prescribed. The name goes in the staff record (regulation 148) and is displayed with the prescribed information (regulation 173(2)). The role is assessed under Element 7.2.2 of the NQS: the educational leader is supported and leads the development and implementation of the educational program and assessment and planning cycle. A compliance direction may be issued for failing to designate one.

The educational leader is the one leadership role in the Regulations defined by what it does rather than by legal liability. It exists to make the program and the planning cycle the responsibility of a named person with the experience to lead it. Assessors look at it twice: under Element 7.2.2 for whether the leader is supported and actually leading, and under Quality Area 1 for whether the program shows it. This page gives the regulation, what the role covers, what support means in practice, the common findings and the award context.

The regulation

118 Educational leader. The approved provider of an education and care service must designate, in writing, a suitably qualified and experienced educator, co-ordinator or other individual as educational leader at the service to lead the development and implementation of educational programs in the service. Note: A compliance direction may be issued for failure to comply with this regulation.

148 Educational leader. The staff record must include the name of the person designated as the educational leader in accordance with regulation 118.

What suitably qualified and experienced means

ACECQA’s guidance states that neither the NQS nor the Regulations are prescriptive about the qualifications, experience, skills or role description of the educational leader. The approved provider decides, and should be able to explain the decision. In practice regulators and assessors expect:

What the role covers

AreaWhat the educational leader doesNQS
Program and curriculumLeads curriculum decision-making so the program is based on the approved framework and on each child (section 168 of the Law, regulation 73).1.1.1, 1.1.2

What support means under Element 7.2.2

The element has two halves: the leader is supported and the leader leads. Assessors test the first with questions about time, authority and professional learning, and the second by looking at the program. Evidence that satisfies both:

Award context

The industrial side is separate from the Regulations. The Children’s Services Award 2010 and the Educational Services (Teachers) Award 2020 contain an educational leader allowance for an employee appointed to the role, and the Children’s Services Award was amended in 2024 to provide non-contact time for the educational leader. The amount and hours are set by the award and the Fair Work Commission, change from time to time and are not part of the National Quality Framework; check the current award. Paying the allowance is not evidence of Element 7.2.2 on its own, and not paying it when the award requires it is a Fair Work matter.

Frequently asked questions

Is an educational leader required?

Yes. Regulation 118 requires the approved provider to designate in writing a suitably qualified and experienced educator, co-ordinator or other individual as educational leader. A compliance direction may be issued for failing to do so, and the designation is checked at Assessment and Rating under Element 7.2.2.

What qualifications does an educational leader need?

None are prescribed. ACECQA’s guidance says the NQS and the Regulations are not prescriptive about the leader’s qualifications, experience, skills or role description; the approved provider decides what suitably qualified and experienced means for the service and should be able to explain it. A diploma or early childhood teaching qualification plus experience with the approved learning framework is the usual expectation.

Can the nominated supervisor or director be the educational leader?

Yes. The Regulations do not prevent one person holding both roles. The assessment question is whether the educational leadership is actually being performed and supported, which is harder to show when the leader also carries the whole operational load.

Does the educational leader have to be displayed?

The name of the educational leader is in the staff record under regulation 148 and is among the prescribed information displayed under regulation 173(2). Keep it current when the role changes.

Is there an allowance for the educational leader?

The Children’s Services Award 2010 and the Educational Services (Teachers) Award 2020 contain an educational leader allowance, and the Children’s Services Award provides non-contact time for the role. The amounts and hours are set by the award and are separate from the National Quality Framework; check the current award.

How is the educational leader assessed?

Under Element 7.2.2 (the educational leader is supported and leads the development and implementation of the educational program and assessment and planning cycle), and indirectly through Quality Area 1, where the program is the evidence of the leadership. Assessors ask about time, role description, professional learning and reporting lines, and look for the leader’s influence in the planning cycle and critical reflection.
