Can an educator take a break if no relief educator is available?

No. Under National Regulation 123, you must maintain required ratios at all times. If no relief staff are available, the educator cannot take a break during operating hours. You would need to arrange additional staffing or reduce child numbers.

Do I need to pay educators for their break time?

This is an employment law question, not an education law question, but generally, breaks are unpaid under the award. However, you may choose to provide paid breaks as an employment benefit. Always comply with the relevant award and employment legislation.

What happens if an educator's break relief doesn't arrive?

The original educator cannot leave the room. Immediately notify your nominated supervisor or approved provider, contact the relief educator to confirm their whereabouts, and implement a contingency plan (e.g., rearrange another educator's break, ask staff to delay breaks, or reduce child numbers if necessary).

Can part-time educators cover breaks?

Yes, provided they are rostered to do so, are appropriately qualified, and their hours account for both their own breaks and any relief they provide. Ensure clear communication about their break relief responsibilities.

How do I manage breaks in multi-room services?

Use a centralised rostering system that shows all breaks across all rooms, with identified relief staff for each. A nominated supervisor or senior educator often coordinates breaks across the service to ensure no room is left unattended.
